CERCLA Exclusions

CERCLA ALSO PROVIDES EXEMPTIONS FOR LIABILITY which involves the treatment of contaminated substances that destroy, eliminate, or permanently immobilize the contaminants such that, the substances no longer present any foreseeable future significant risk to public health, welfare or the environment. No byproduct of the treatment or destruction process shall present any significant hazard to public health, welfare or the environment and all byproducts are themselves treated, destroyed, or contained in a manner which assures that such byproducts do not present any foreseeable future significant risk to public health, welfare or the environment. The President shall then provide such person with a covenant not to sue with respect to future liability under CERCLA and such person shall not be liable under section 106 or 107 with respect to such release or threatened release at a future time.

Meets All §260.43 Criteria for Legitimate Recycling

The Cement Lock process conforms to the Transfer-Based Exclusion definition for Solid Wastes by meeting the Legitimacy Criteria. Conditions which include;

  • that contaminated secondary materials are a constituent and
    contribute to the recycling process and used as an effective substitute for a valuable commercial product, or,
  • that is substituted for a commercial product and sold to a 3rd Party; or,
  • The Product is managed in a manner consistent with the management of analogous raw materials; or,
  • The Product does not exhibit unsafe characteristics that are not found in analogous products.
